Challenge Rules and Conditions

PARTICIPATING IN THE CHALLENGE DOES NOT OBLIGATE PARTICIPANT TO ENGAGE AMP TELECOM FOR SERVICES. ALL FEDERAL, STATE, LOCAL, AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED.

1. Eligibility

AMP Challenge (the “Challenge”) is not open to residential/non-business accounts, services that do not include local and long distance calls to the public switched telephone network, trial accounts, non-production accounts such as alpha or beta cycle accounts, Google Voice accounts, wholesale telephone services or promotional pricing, products and services that are not available from Amp Telecom, or business accounts not established more than sixty (60) days prior to submission. The Challenge is subject to federal, state, and local laws and regulations.

Only one submission per company will be accepted.

2. Sponsor

The Challenge is sponsored by Amp Telecom, LLC, located at 2806 Flintrock Trace, A101, Austin, Texas 78738.

3. Agreement to Official Rules

Participation in the Challenge constitutes entrant’s full and unconditional agreement to and acceptance of these Official Rules and the decisions of the Sponsor, which are final and binding. Winning an award is contingent upon being compliant with these Official Rules and fulfilling all other requirements set forth herein.

4. Challenge Period

The Challenge begins on July 04, 2017 at 12:00 AM CST and ends on August 31, 2017 at 11:59:59 PM CST (the “Challenge Period”). Submissions will only be accepted online for the duration of the Challenge.

5. How to Participate

Online: This method of entry will be available by visiting our website (https://www.amptelecom.com/500-dollar-challenge/) and following the directions provided to fill out the entry information, and submit.

The Person submitting the entry certifies that he/she has the authority to add, modify, and terminate telephone related services for the Participant. Participant must completely and accurately enter all fields on the Challenge entry page and must upload a complete and legible copy of Participant’s current phone bill/record.

Sponsor may contact the Participant to clarify Participant’s bill submission or other details.

6. Award Details

If Sponsor cannot provide similar or better phone service to Participant at a cost of at least forty percent (40%) cheaper than Participant’s current business telephone services rate, Sponsor will mail Participant a check for Five Hundred Dollars ($500) within thirty days (30) of the Challenge Period end.

Sponsor may require Participant to complete a W9 before the award is disbursed to Participant.

Award shall be in United States currency (USD).

7. Award

Five hundred dollars ($500.00).

8. General Conditions

The Sponsor reserves the right in its sole discretion to disqualify any Participant it finds to be tampering with the entry process or the operation of the Challenge or falsifying or providing fraudulent information or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to damage the website or undermine the legitimate operation of the Challenge or knowingly providing false information may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor reserves the right to seek damages (including attorney’s fees) and any other remedies from any such Participant to the fullest extent permitted by law. Participant agrees not to disclose and/or disseminate any information regarding any award given by Sponsor to Participant. Participant agrees and acknowledges that any information regarding an award given to Participant by Sponsor will cause irreparable harm to Sponsor and is subject to liquidated damages of Five Thousand Dollars ($5000) per incident. Failure by the Sponsor to enforce any provision of these Official Rules shall not constitute a waiver of that provision.

9. Release and Limitations of Liability

By participating in the Challenge, Participants agree to release and hold harmless the Sponsor, and each of their respective parents, subsidiaries, affiliates, advertising and promotion agencies, other companies associated with the Challenge, and each of their respective officers, directors, employees, shareholders, representatives, and agents (the Released Parties) from and against any claim or cause of action arising out of participation in the Challenge or receipt or use of the award, including, but not limited to: (a) any technical errors associated with the Challenge; (b) unauthorized human intervention in the Challenge; (c) mechanical, network, electronic, computer, human, printing or typographical errors; (d) any other errors or problems in connection with the Challenge, including, without limitation, errors that may occur in the administration of the Challenge, the entrant’s incorrect uploading of the bill/record, the processing of entries submission downloads or in any Challenge-related materials; or (e) injury, death, losses or damages of any kind, to persons or property which may be caused, directly or indirectly, in whole or in part, from entrants participation in the Challenge or acceptance, receipt or misuse of the award. Entrant further agrees that in any cause of action, the Released Parties liability will be limited to the cost of entering and participating in the Challenge, and in no event shall the entrant be entitled to receive attorney’s fees. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Challenge. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.

10. Disputes

Except where prohibited, each entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Challenge or any award given shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Travis County, Texas. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrants rights and obligations, or the rights and obligations of the Sponsor in connection with the Challenge, shall be governed by, and construed in accordance with, the laws of Texas, without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than Texas.

11. Privacy

Information collected from entrants is subject to Sponsor’s privacy policy. However, Sponsor may use information obtained in Participant’s submission for promotional purposes. If information is used for promotional purposes, Sponsor will not identify Participant or release any identifying information.
